Terms and Conditions
Overview
The AIKA Health website, located at www.aikahealth.com.au (referred to as the "Website"), and the services provided through it, are operated and owned by AIKA HEALTH PTY LTD, ABN 74 674 818 485 (referred to as "AIKA", "we", "us", or "our").
AIKA offers a range of services through the Website, including:
Pathology services (referred to as "Pathology Services");
Corporate Flu Vaccinations, administered at workplace locations (referred to as "Corporate Flu Vaccinations");
Employee health checks, either at the workplace or designated medical practices (referred to as "Corporate Health Checks");
Insurance-related health checks and reports, conducted at your location (referred to as "Insurance Health Checks");
Additional services provided by AIKA from time to time, collectively referred to as "AIKA Services".
Throughout these terms, "you" or "Customer" refers to individuals receiving AIKA Services.
Pathology Services
You can select specific pathology tests, or test packages offered by AIKA, via the Website. During this process, you will be required to provide certain personal information. Upon receiving payment for your chosen tests, AIKA will send you a pathology request form via email. You will need to present this form at one of our partner Collection Centres for testing.
AIKA is not responsible for any fees incurred at unaffiliated labs if you attend one against our guidance. In these instances, we will direct the lab to charge the customer directly.
We aim to deliver your test results within 24 to 48 hours, though some rarer tests may take longer. Your results will be presented with clear reference points indicating whether they fall within normal ranges. In cases of significantly abnormal results, one of our registered medical professionals will review them, and we will guide you to further medical care. However, please note that AIKA does not establish a traditional doctor-patient relationship, and we recommend discussing all results with your healthcare provider.
AIKA:
Does not diagnose or treat conditions based on the test results provided;
Shares test results only with the email address you provided during the ordering process, and only shares information about notifiable infectious diseases with the relevant health authority;
Cannot be held liable for any results provided from non-affiliated labs;
Is not responsible for follow-up medical advice or actions based on test results. For issues related to infectious diseases, you may be contacted directly by public health authorities.
Terms of Use
By ordering AIKA Services through the Website or booking appointments for services such as Corporate Flu Vaccinations, Corporate Health Checks, or Insurance Health Checks, you confirm:
That you have read and understood these terms and agree to be bound by them;
That you consent to the collection, use, and transmission of your personal information as outlined, including receiving your pathology test results via email;
That you agree to make payments using the Secure Pay system or other approved payment methods on the Website;
That you consent to receiving communications from us as outlined in these terms.
AIKA may modify these terms from time to time. When changes are made, the updated terms will be posted on the Website, and the date of posting will indicate when they become effective. Your continued use of the Website after changes are posted will indicate your acceptance of the new terms.
Eligibility and License for Service
To access AIKA Services, you must be at least 18 years old. Services are intended for personal use, and any purchased services are limited to a single customer only.
Upon payment for services, AIKA grants you a limited, non-transferable license to use the Website and associated materials (including pathology request forms and test results) strictly for personal use and in accordance with these terms.
Payment and Refund Policy
You are required to pay for AIKA Services at the time of order via the Secure Pay payment system on the Website, unless your employer is covering the cost.
For Pathology Services, you may cancel your order within 7 days of placement, provided that no samples have been collected. Refunds are not available for services where samples have been taken or if more than 7 days have passed since the order was placed. Delays in receiving results do not entitle you to a refund.
Website Usage Rules
You agree to:
Use the Website and AIKA Services solely for lawful purposes;
Avoid any actions that exploit or harm AIKA's brand or intellectual property, except for personal use of the services purchased;
Refrain from disrupting others' experience with the Website;
Not engage in fraudulent activities or introduce harmful technology to the Website;
Ensure that your network and device are suitable for using the Website and updating as required.
Suspension or Termination of Service Access
AIKA reserves the right to suspend or terminate your access to AIKA Services at any time if it believes you have violated these terms or if it deems suspension or termination necessary. You will be notified by email if such action is taken.
Complaints Process
If you wish to file a complaint regarding AIKA Services, you can contact us via email at ord@aikahealth.com.au, using the subject line "Complaint". Please provide a detailed description of your complaint, along with any supporting documentation. We aim to respond within 14 business days.
Liability and Disclaimers
AIKA does not guarantee the continuous availability or flawless operation of the Website, acknowledging that malfunctions or delays may occur. These issues are inherent risks of online services.
AIKA disclaims any liability for:
Losses or damages caused by third-party actions or systems;
Losses arising from technological issues, such as viruses or system failures;
Any medical decisions made based on information provided by AIKA Services.
We are not liable for any harm resulting from ignoring our recommendations, including seeking professional medical advice when necessary.
Indemnification
By using AIKA Services, you agree to indemnify and hold AIKA and its affiliates harmless from any claims arising out of your use of our services or breach of these terms.
Notice and Communication
We may send notices to you by email or other written communication to the details provided by you. You can contact AIKA at ord@aikahealth.com.au.
Assignment
AIKA may assign or transfer its rights and obligations under this agreement, including subcontracting any part of the services. AIKA may transfer ownership of the Website to a third party without your consent, and you acknowledge that your personal information may be transferred as part of this process.
Severability
If any provision in these terms is deemed unenforceable, the remaining provisions will still apply, and the invalid provision will be modified to reflect the intent of the original clause as closely as possible.
Entire Agreement
These terms represent the entire agreement between AIKA and you, superseding all prior agreements.
Intellectual Property
All content, logos, trademarks, and materials related to AIKA Services are the exclusive property of AIKA and are protected by copyright and intellectual property laws.
Governing Law
These terms are governed by the laws of New South Wales, Australia, and any disputes will be resolved within the jurisdiction of the New South Wales courts.
Acknowledgments and Consents
By using AIKA Services, you confirm that you have read and agreed to these terms, and that you are responsible for any costs associated with your use of the Website, including telecommunications fees. You also consent to AIKA's use of your personal and sensitive data for the purposes outlined here.
